Terms of Service - MPS-Agentic

1. Acceptance of Terms

By accessing or using MPS-Agentic ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

MPS-Agentic provides a malicious content scanning service that analyzes files for potential threats. The Service includes:

Web-based file scanning interface
API access for automated scanning
Scan history and reporting

3. User Accounts

To use the Service, you must create an account and provide accurate, complete information. You are responsible for:

Maintaining the confidentiality of your account credentials
All activities that occur under your account
Notifying us immediately of any unauthorized use

4. Acceptable Use

You agree NOT to use the Service to:

Upload files you do not have the right to scan
Attempt to circumvent security measures
Interfere with the Service's operation
Use the Service for any illegal purpose
Resell or redistribute the Service without authorization

5. Free Trial and Subscription

Free Trial: New users receive a 7-day free trial with Starter plan features. No credit card is required to start the trial.

After Trial: When your trial ends, you may subscribe to any paid plan (Starter $10/month, Builder $29/month, Professional $129/month, Enterprise 5 $1000/month, Enterprise 10 $2000/month). If no plan is selected, you will have a 7-day grace period. After the grace period, your account will be paused until you select a plan.

Billing: Paid subscriptions are billed monthly through Stripe, our secure payment processor. Subscriptions auto-renew unless cancelled. You can manage your subscription at any time through your dashboard. Refunds are handled on a case-by-case basis.

6. API Usage

API access is subject to rate limits based on your subscription plan. You must keep your API key confidential. We reserve the right to revoke API access for abuse or violation of these terms.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. We do not guarantee that:

The Service will detect all threats
The Service will be uninterrupted or error-free
Scan results are 100% accurate

8. Limitation of Liability

To the maximum extent permitted by law, StrategicPromptArchitect.ca shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service.

9. Changes to Terms

We may modify these terms at any time. Continued use of the Service after changes constitutes acceptance of the new terms. We will notify users of significant changes via email.

10. Termination and Data Retention

We reserve the right to suspend or terminate your account at any time for violation of these terms. You may cancel your subscription at any time through your dashboard.

Upon cancellation:

You retain access until the end of your current billing period
Your scan history is retained for 30 days after account expiration
You will receive email notifications at 7 days and 1 day before data removal
After 30 days, your data will be marked for deletion
